    FAA threw a temper tantrum when a judge ruled they couldn't fine a guy who flew a drone and took video and pictures for a college which then used the video and photos in its advertisements.

    Its seems that AC 91-57 really was just a glorified memo, not regulation or law. AC = Advisory Circular. ADVICE.
    Not enforceable as law, but potentially useful in a civil suit if you do something that you are advised not to do and cause damage, injury or death.

    So FAA started throwing regulations at the wall... completely unrealistic and unenforceable regulations.

    CONGRESS as part of the FAA funding authorization put in a clause that FAA could NOT regulate model aviation being conducted within reasonable compliance of standards set by establishshed "community based organizations" (with the only widespread organization in USA being AMA)

    FAA essentially said "F U" to congress and made up the regulation that required registration.

    A court ruled that FAA was inviolatin of FEDERAL LAW PASSED BY CONGRESS.

    FAA weasled around and came up with a way to try reinstating the registration system.

    And the war between FAA vs model aviation, the courts and Congress continues.

    FAA has basicly dug a hole and buried themselves on the issue. They can't possibly win without a new act of congress.

    FAA has now published a modified AC 91-57A....


    But... its still an ADVISORY CIRCULAR....

      If you, like many of us, belong to a local club, that club probably requires membership in AMA; IMO, that satisfies the registration requirement. The leaders of the AMA think so, too. I'm one who registered, though, so already have the FAA's number on my models, along with my AMA registration. I think that if/when a remotely piloted aircraft is recovered from causing damage, they will find NO registrations of any kind, and won't be able to trace the owner, so registration rules will be moot, in any case.

        It’s another knee jerk reaction by the federal government to show the general public "Hey! Looky what we're doing to make things safer!"
        The only people that will register, and abide by the law are the law abiding citizens. For those on the edge it may, just may cause a few to think twice about doing something stupid if they know they are suppose to register and what the penalty could be if they don't. Or, if they do and do something stupid and get caught doing it. The next question is did they actually put their number on the vehicle and if they don't how will they get caught?
        The reality is you can't really regulate stupid. We see it all the time in any activity that is regulated. Even highly regulated activities. There are always going to be those that either totally disregard the implications of their actions or are too stupid to know the difference or are willing to take a chance to get away with it.
        In rare cases you are going to see a simple error or mistake. These may be out of ignorance, or maybe just a lack of awareness without any ill intent. We see this in our hobby on occasion and fortunately very few transgressions cause serious harm to innocent bystanders. For a normal person these are learning moments.

        In any technology or activity that has the potential for doing harm, the law-abiding that understand the dangers involved are always the ones who are inconvenienced by regulation. And then, on occasion there is the suffering of the victims of the deviants and numb skulls that ruin it for everybody.
        On even more rare occasions we will always see even a law-abiding person make a mistake but fortunately these are very rare.
        Unfortunately, history has proven that these rare occasions, with the government involved, will result in even more regulation and more severe penalties for the smallest infraction, if they can get away with it. Registration is just the beginning. I would wager that within 5-10 years all of us will have to go to school for some level of instruction, pass a written and oral test and pass an operational flight check.
        The only recourse we have is for EVERYONE in the hobby to write or call our state representatives and express our concerns. We are a small community but like many others the squeaky wheel gets the grease. DO NOT rely on the AMA alone to lobby for us. It’s about power and control and the AMA is not immune. They were dancing a jig when the new rule came out about belonging to a “Community based organization”. Yes, the AMA promotes safety and they will tell you that's what its all about but make no mistake; they were ecstatic with the increase in membership and the gleam of dollar signs in their eyes.
